The use of medical records in research can yield information that is difficult to obtain by other means. When such records are released to investigators in identifiable form, however, substantial privacy and confidentiality risks may be created. These risks become more common and more serious as medical records move to an electronic format. In 1996, the state of Minnesota enacted legislation with respect to consent requirements for the use of medical records in research. This legislation has been widely criticized because—it (...) is claimed—it creates an unnecessary impediment to research. In this article, we show that these arguments rest upon misinterpretation and/or misrepresentation of the 1996 legislation. A consent requirement had actually been present in Minnesota since 1976 (though codified in a patient rights statute rather than a privacy statute). The 1996 law does not require specific consent, as often claimed, but rather only a general authorization. The campaign against the Minnesota legislation appears to have been motivated by concern with respect to the then impending federal privacy rule. The HIPAA rule, as enacted, is in fact less stringent with respect to consent than the Minnesota consent law. On the other hand, the Minnesota consent law has not been effectively applied or enforced. As we change the way we manage sensitive medical information, new efforts are needed to provide protection against the confidentiality risks in research. Patient consent is an important tool in this regard. New instrumentalities are needed to solicit and document consent. (shrink)

Recently, growing numbers of interns, apprentices, and volunteers are being recruited to work seasonally on ecologically oriented and organic farms across the global north. To date, there has been very little research examining these emergent forms of non-waged work. In this paper, we analyze the relationships between non-waged agricultural work and the economic circumstances of small- to medium-size farms and the non-economic ambitions of farm operators. We do so through a quantitative and qualitative analysis of farmers’ responses to two surveys (...) we conducted of farmers using non-waged workers in Ontario, Canada. We situate our analysis within debates on the agrarian question, which we contend requires an account for both the economic and non-economic dimensions of new forms of non-waged work on farms. We suggest that many ecologically oriented farm operators are struggling financially and report low gross on-farm revenues and personal incomes. We argue that in addition to relying on off-farm incomes and self-exploitation, many farms are managing to persist in a challenging economic climate through their use of intern, apprentice, and volunteer labor. However, we also suggest that the growth of non-waged work on farms is not simply being driven by economic processes but also a series of non-economic relationships focused on non-institutional farmer training, the pursuit of sustainability, and social movement building. We suggest, the “economic” and “non-economic” dimensions of internships, apprenticeships, and forms of volunteerism sit uneasily alongside of one another, generating questions about the politics, ethics, and sustainability of non-waged work and ecological farming. No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

The civic republican tradition in political thought includes Niccolo Machiavelli, Jean-Jacques Rousseau, and Alexis de Tocqueville. The belief that it is imperative that citizens participate actively and disinterestedly in public affairs, i.e., that they possess "civic virtue" or "public spirit" is a prominent family resemblance between its members. Civic republican thought has undergone a recent resurgence, and one consequence is that political philosophers and other theorists have begun to ask whether liberals can take civic virtue seriously. Certain critics of liberalism, (...) including Michael Sandel and Charles Taylor, have answered this question in the negative. They give a variety of reasons for this answer, ranging from the inability of the atomistic ontologies underlying many liberal theories to make sense of the existence of a common good to the inability of the liberal state to concern itself with the character of its citizens. ;For the most part, unsurprisingly, these antiliberals direct their arguments at the work of twentieth-century "deontological" liberals such as John Rawls and Ronald Dworkin. While Rawls and Dworkin say relatively little about civic virtue, many earlier liberals believed firmly in its importance. John Stuart Mill's centrality to the liberal tradition and the thoroughgoing nature of his liberalism make him an especially interesting "civic liberal." My central thesis is that the civic and liberal components of his political philosophy combine to form a coherent whole. In my early exegetical chapters I provide the first systematic exposition of the frequently ignored civic component. I then address the work of several of Mill's interpreters who either explicitly or implicitly point to possible problems with his attempt to weave together the civic and liberal strands in his thought, and conclude that these problems are either not real or not insoluble. Finally, I consider whether the arguments which Sandel and Taylor, et. al., have given to show that contemporary liberal theories cannot consistently incorporate the civic republican belief in the importance of active and disinterested civic participation might have force against Mill. I show that they do not, and not simply because On Liberty is not A Theory of Justice but because the many of the objections are poorly reasoned. (shrink)

It considers whether the comparison adheres to a competitive model of ethics or a multidirectional model.

Approximately one trillion, trillion, trillion (101728) years from now, the universe will suffer a “heat death.” What are the existential implications of this fact for us, today? This chapter explores this question through Lyotard’s fable of the explosion of the sun, and its uptake and extension in the works of Keith Ansell Pearson and Ray Brassier. Lyotard proposes the fable as a kind of “post-metanarrative” sometimes told to justify research and development, and indeed the meaning of our individual lives, after (...) credulity in metanarratives has been lost: it replaces the adventure of the subject of history aimed towards the perfection and emancipation of the human with the adventure of inhuman, negentropic processes aimed towards the survival and extension of complexity. Ansell Pearson illustrates how contemporary transhumanists employ such a narrative, and critiques it from a Nietzschean perspective as preserving values which are nihilistic. Brassier employs it to argue against the phenomenological view that thought must be bounded by the horizonal correlate of the body and the earth, and to advance the argument that thought should abandon all meaning and purpose and embrace nihilism. This final chapter seeks to negotiate each of these positions, showing how Lyotard’s thought helps us to reflect on the existential significance of the “deep time” revealed by contemporary science. The recruitment and socialization (enculturation) of spirit mediums in the United States is investigated through ethnographic interviews, participant observation and library biographies in Lily Dale, New York. Spirit mediumship, alleged transfer of information from departed souls to the living through another living human (the medium) is a deviant way of knowing in this society. Most children with signs of mediumistic ability are discouraged by family and community. Moving into the role requires positive definitions and social support, such as in (...) Spiritualist Church classes. Given general scepticism about intuition in Western society, even mediums themselves look for "confirmations" to validate their nonrational communications. Thus, the dominance of scientific rationality is accepted to an important degree even by this group that practices an alternate way of knowing. (shrink)

The causal premise of the evolutionary debunking argument contends that human moral beliefs are explained by the process of natural selection. While it is universally acknowledged that such a premise is fundamental to the debunker’s case, the vast majority of philosophers focus instead on the epistemic premise that natural selection does not track moral truth and the resulting skeptical conclusion. Recently, however, some have begun to concentrate on the causal premise. So far, the upshot of this small but growing literature (...) has been that the causal premise is likely false due to the seemingly persuasive evidence that our moral beliefs are in fact not the result of natural selection. In this paper, I argue that this view is mistaken. Specifically, I advocate the Innate Biases Model, which contends that there is not only compelling evidence for an evolved cognitive capacity for acquiring norms but also for the existence of an evolutionarily instilled set of cognitive biases that make it either more or less likely that we adopt certain moral beliefs. In Phenomenology of Spirit (1806) Hegel is often held to have announced the end of history, where 'history' is to be understood as the long pursuit of ends towards which humanity had always been striving. In this, the first book in English to thoroughly critique this entrenched view, Eric Michael Dale argues that it is a misinterpretation. How do communities establish shared communication systems? The Common Knowledge view assumes that symbolic conventions develop through the accumulation of common knowledge regarding communication practices among the members of a community. In contrast with this view, it is proposed that coordinated communication emerges a by‐product of local interactions among dyads. A set of multi‐agent computer simulations show that a population of “egocentric” agents can establish and maintain symbolic conventions without common knowledge. In the simulations, convergence to a single conventional system (...) was most likely and most efficient when agents updated their behavior on the basis of local rather than global, system‐level information. The massive feedback and parallelism present in the simulations gave rise to phenomena that are often assumed to result from complex strategic processing on the part of individual agents. The implications of these findings for the development of theories of language use are discussed. (shrink)

ABSTRACT Constitutive panpsychism is the doctrine that macro-level consciousness—that is, consciousness of the sort possessed by certain composite things such as humans—is built out of irreducibly mental features had by some or all of the basic physical constituents of reality. On constitutive panpsychism, changes in macro-level consciousness amount to changes in either the way that micro-conscious entities ‘bond’ or the way that micro-conscious qualities ‘blend’. I pose the ‘Selection Problem’ for constitutive panpsychism—the problem of explaining how high-level functional states of (...) the brain ‘select’ micro-conscious qualities for bonding or blending. This article discusses some philosophical theories of causation and their application to several areas of science. Topics addressed include regularity, counterfactual, and causal process theories of causation; the causal interpretation of structural equation models and directed graphs; independence assumptions in causal reasoning; and the role of causal concepts in physics. In connection with this last topic, this article focuses on the relationship between causal asymmetries, the time-reversal invariance of most fundamental physical laws, and the significance of differences among varieties of (...) differential equations in causal interpretation. Participants in the cognitive phenomenology debate have proceeded by (a) proposing a bifurcation of theoretical options into inflationary and non-inflationary theories, and then (b) providing arguments for/against one of these theories. I suggest that this method has failed to illuminate the commonalities and differences among conscious intentional states of different types, in the absence of a theory of the structure of these states. I propose such a theory. In perception, phenomenal-intentional properties combine with somatosensory properties to form P-I property clusters (...) that serve as phenomenal modes of presentations of particulars. In imagination, somatosensory properties are replaced with phenomenal-intentional properties whose intentional objects are somatosensory properties, thus resulting in imaginative facsimiles of perceptual P-I property clusters. Such structures can then be used as phenomenal prototypes that pick out individuals and kinds. Sets of such prototypes constitute a subject’s conception of individuals and kinds. Combined with a few additional elements, these imaginative P-I property clusters serve as the building-blocks of conscious cognitive states. Different ways of carving up theoretical space classify my theory either as inflationary or as non-inflationary. I conclude that the theory is anti-inflationary in letter but inflationary in spirit. Hasker’s “social” Trinity theory is subject to considerable philosophical problems. More importantly, the theory clashes with the clear New Testament teaching that the one God just is the Father alone. Further, in light of five undeniable facts about the New Testament texts, we can know that the authors of the New Testament thought that the only God was just the Father himself, not the Trinity. Hasker can neither deny these facts nor defeat the strong evidence they provide that in affirming (...) a triune God in the late 4th century, catholic tradition departed from apostolic teaching about the one God. It is intuitive that free action depends on consciousness in some way, since behavior that is unconsciously generated is widely regarded as un-free. But there is no clear consensus as to what such dependence comes to, in part because there is no clear consensus about either the cognitive role of consciousness or about the essential components of free action. I divide the space of possible views into four: the Constitution View (on which free actions metaphysically consist, at least in part, (...) in phenomenally conscious episodes of a special sort), the Causal-Dependence View (on which free actions are necessarily caused by conscious episodes), the Counterfactaul-Dependence View (on which free actions necessarily counterfactually dependent on conscious episodes of certain types), and the Independence View (on which there are no necessary dependence-relations that hold between free action and conscious episodes). After surveying recent empirical literature that purports to show that consciousness plays a smaller role in generating action than is usually supposed, I conclude that it is plausible that free action depends on consciousness in two ways. First, free action causally depends on consciousness control. Second, free action counterfactually depends on the agent's being responsive to certain reasons. (shrink)
